Talent Showcase – Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Talent Showcase platform ("Talent Showcase", "we", "us" or "our"). By creating an account or using the platform, you agree to these Terms. If you are using Talent Showcase on behalf of a company (like a recruitment agency), you confirm you have authority to bind that company to these Terms.

If you do not agree to these Terms, please do not use the platform.

1. Overview of the Service

Talent Showcase is a web-based tool that allows recruitment agencies to upload candidate resumes, which are parsed, anonymised using AI, and published as private, shareable profiles ("Showcases") that can be shared with hiring managers.

2. Your Account

You must provide accurate and complete information when creating an account. You're responsible for keeping your login credentials safe and secure. Please notify us immediately if you suspect unauthorised access to your account.

3. Use of the Platform

You agree to:

Use the platform only for lawful recruitment purposes;
Only upload resumes you are legally allowed to process (e.g. with candidate consent or other lawful basis);
Not attempt to reverse-engineer, copy, or interfere with the platform's functionality;
Not upload any illegal, harmful, or sensitive personal data unless explicitly permitted by law.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Candidate Data & Anonymisation

You are solely responsible for ensuring that you have a lawful basis (e.g. consent or legitimate interest) to upload and process candidate data. Talent Showcase provides tools to help anonymise and present this data securely, but you remain the data controller for any personal information you upload.

You must not use the platform to identify or re-identify individuals in any published anonymised profile unless the candidate has explicitly consented to that disclosure.

5. Data Protection & Privacy

We process data on your behalf in accordance with applicable data protection laws (including the UK GDPR). Please see our Privacy Policy and Data Processing Agreement (DPA) for more details.

You remain responsible for complying with your obligations as a data controller. We will never use your candidates' data for any purpose other than providing the service.

6. Intellectual Property

We (or our licensors) own all rights to the Talent Showcase platform, including all branding, design, software, and underlying technology.

You retain ownership of the content you upload (e.g. candidate CVs, job notes), but by using the platform, you grant us a limited licence to process and store that content solely for the purpose of providing our service.

7. Service Availability

We aim to provide a reliable, always-on service, but we do not guarantee uninterrupted access. The platform may occasionally be unavailable due to maintenance or issues beyond our control.

We will try to give notice of planned outages wherever possible.

8. Termination

You can stop using Talent Showcase at any time. You may request to have your account and associated data deleted by contacting joe@talentshowcase.co.uk.

We may suspend or terminate your access if:

You breach these Terms;
We're legally required to do so;
The service is being discontinued.

9. Fees and Payments

If you are on a paid plan, you agree to the pricing and billing terms presented at signup or communicated by us. We may change our pricing with notice.

Failure to pay may result in suspension or termination of your account.

10. Third-Party Services

Talent Showcase uses trusted third parties (like Supabase and OpenAI) to operate key features. These providers are subject to data protection agreements and only act on our instructions.

We are not liable for issues caused by third-party platforms we do not control.

11. Liability

Talent Showcase is provided "as is" and "as available". To the fullest extent allowed by law:

We do not guarantee the platform will be error-free or suitable for every use;
We are not responsible for any indirect or consequential losses;
Our total liability to you is limited to the amount you paid us in the past 12 months.

Nothing in these Terms limits your rights under consumer law, or excludes liability for fraud, death or personal injury caused by negligence.

12. Changes to These Terms

We may update these Terms from time to time. If we make major changes, we'll let you know via email or within the platform. Your continued use of Talent Showcase after changes means you accept the new Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. If there's a dispute, we'll aim to resolve it through good-faith discussion before taking legal steps. Any disputes will be resolved in the UK courts.
